This Privacy Policy is incorporated into the Terms of Service for the RADAR℠ Platform. Definitions used in the Terms of Service have the same meanings in this Privacy Policy.  Together, the Master Agreement, the Terms of Service, and this Privacy Policy govern your use of the Platform.

We respect your privacy and are committed to protecting it through our compliance with this policy.

This policy describes the types of information we may collect from you or that you may provide when you visit the RADAR℠ Platform and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect:

  • On this Platform.
  • In email, text, and other electronic messages between you and this Platform.

It does not apply to information collected by:

  • Us offline or through any other means, including on any other Platform operated by Provider or any third party; or
  • Any third party, including through any application or content (including advertising) that may link to or be accessible from or through the Platform.

Please read this policy carefully to understand our policies and practices regarding your information and how it will be processed. If you do not agree with our policies and practices, your choice is not to use our Platform. By accessing or using this Platform, you agree to this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of this Platform after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Children Under the Age of 18

Our Platform is not intended for children under 18 years of age. No one under age 18 may provide any information to or on the Platform. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on this Platform or on or through any of its features. Information We Collect About You and How We Collect It

We collect several types of information from and about users of our Platform, including information:

  • By which you may be personally identified, such as name, postal address, email address, telephone number, or any other identifier by which you may be contacted online or offline ("personal information");

  • About your internet connection, the equipment you use to access our Platform, and usage details.

  • From Your Company.
  • Directly from you when you provide it to us.
  • Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses, and information collected through cookies and other tracking technologies.
Information You Provide to Us

The information we collect on or through our Platform may include:

  • Information that you provide by filling in forms on our Platform. This includes information provided at the time of registering to use our Platform, subscribing to our service, posting material, or requesting further services. We may also ask you for information when you report a problem with our Platform.
  • Records and copies of your correspondence (including email addresses), if you contact us.
  • Details of transactions you carry out through our Platform [and of the fulfillment of your orders. You may be required to provide financial information before placing an order through our Platform].

You also may provide information to be published or displayed (hereinafter, "posted") on public areas of the Platform, or transmitted to other users of the Platform or third parties (collectively, "User Contributions"). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Platform with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Platform, we utilize automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to our Platform, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Platform.

  • Functional Cookies: To provide you with a great experience on this Website, we provide the functionality to set your preferences for how this site runs when you use it. To remember your preferences, we need to set cookies so that this information can be accessed whenever you interact with a page that is affected by your preferences.
  • Strictly Necessary or Essential Cookies: These cookies are necessary for the Site to function and cannot be switched off in our systems. For example, we use cookies to authenticate you. We do not process personal data revealing Your racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation.

Third-Party Use of Cookies and Other Tracking Technologies

Some content or applications, including advertisements, on the Platform are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Platform. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different Platforms and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties' tracking technologies or how they may be used. Third Party Services. We use third party services such as those listed below to improve and help understand your use of the Site.

  • Sentry.io. Our Service uses Sentry.io to help analyze how users use the Site. Sentry.io is a web analytics service. Web analysis is the gathering, collection and analysis of data about the behavior of visitors to websites.
  • Google Analytics™. Our Service uses Google Analytics to analyze how users interact with the Site. Google Analytics is a web analytics service provided by Google that tracks and reports website traffic. This information helps us understand user behavior and improve the Site.   • Auth0 by Okta™. Our Service uses Auth0 to manage user authentication and authorization securely. Auth0 is an identity management platform that provides authentication and authorization services, ensuring that only authorized users can access certain features of the Site. How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

To operate our Service. We use your personal information to:

  • provide, administer, and operate our Service;
  • support your relationship with RADAR by designing content that is suitable to your needs and alerting you to new product and service offerings as they become available;
  • to monitor the usage and performance of Service;
  • to enhance our Service for optimal user experience;
  • help diagnose problems with our Service;
  • provide maintenance, support, and customer service for our Service;
  • create a user profile to better serve you; and
  • contact you either electronically or otherwise.

For research and development. We analyze your use of our Service to conduct research and analysis, improve our Service, and to develop new products and services, including by studying user demographics and overall use of our Service and other products and services.

To create anonymous data. We may create anonymous, aggregated or de-identified data from your personal information and other individuals whose personal information we collect. We make personal information into anonymous, aggregated or de-identified data by removing information that makes the data personally identifiable to you. We may use this anonymous, aggregated or de-identified data and share it with third parties for our lawful business purposes, including to analyze and improve our Service and promote our business.

To send you marketing and promotional communications. We may send you Platform-related marketing communications as permitted by law. In addition, we may use personal information that we get from you or our business partners in order to provide marketing for webinars that we are involved in hosting. You will have the ability to opt-out of our marketing and promotional communications as described in the Access and Choice section below. Note that this opt-out does not apply to information provided to RADAR as a result of a product or service purchase, or other transactions.

To comply with law. We use your personal information as we believe necessary or appropriate to comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities, as detailed below.

For compliance, fraud prevention, and safety. We may use your personal information and disclose it to law enforcement, government authorities, and private parties as we believe necessary or appropriate to:

  • protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims);
  • enforce the terms and conditions that govern our Service; and
  • protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity.

Use for New Purposes

We may use your personal information for reasons not described in this Privacy Policy where permitted by law and the reason is compatible with the purpose for which we collected it. If we need to use your personal information for an unrelated purpose, we will notify you and explain the applicable legal basis.

Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose personal information that we collect on you or Your Company provide as described in this privacy policy:

  • To our subsidiaries and affiliates.
  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of  Provider's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Provider about our Platform users is among the assets transferred.
  • To fulfill the purpose for which you or Your Company provide it.
  • For any other purpose disclosed by us when you or Your Company provide the information.
  • With your or Your Company’s consent.

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our Terms of Use or the Master Agreement and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Provider, our customers, or others.

As a component of this Privacy Policy, Provider maintains a list of sub-processors which are utilized to provide the service offering. For a comprehensive listing of sub-processors please submit a request through the “Contact Information” section, below.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.
  • Promotional Offers from the Provider. If you do not wish to have your email address used by Provider to promote our own or third parties' products or services, you can opt out by logging into the Platform and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an email stating your request to privacy@riscpoint.com. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions or click “Unsubscribe” in the applicable marketing communications.
  • Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt out by logging into the Platform and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an email stating your request to privacy@riscpoint.com.

We do not control third parties' collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's Platform.

Accessing and Correcting Your Information

Your State Privacy Rights

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.

California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to:

  • Confirm whether we process their personal information.
  • Access and delete certain personal information.
  • Correct inaccuracies in their personal information, taking into account the information's nature processing purpose.
  • Data portability.
  • Opt-out of personal data processing for:
    • targeted advertising (excluding Iowa);
    • sales; or
    • profiling in furtherance of decisions that produce legal or similarly significant effects (excluding Iowa and Utah).
  • Either limit (opt-out of) or require consent to process sensitive personal data.

Nevada provides its residents with a limited right to opt-out of certain personal information sales. Residents who wish to exercise this sale opt-out rights may submit a request to this designated address: privacy+nevada@riscpoint.com. However, please know we do not currently sell data triggering that statute's opt-out requirements.

User Rights for Residents of the European Union

For the purposes of the GDPR, Provider operates as a “Processor” on behalf of the “Controller”. Our obligation is to meet the requirements as outlined in Chapter 28 of the GDPR. If Provider receives a data subject access request, as defined under Chapter 3 of the GDPR, we will provide notice to the “controller” for fulfilment of the request. Where applicable, Provider will enter into a contractual arrangement with the “Controller” that sets out the subject-matter and duration of the processing, the nature and purpose of the processing, the type of personal data and categories of data subjects and the obligations and rights of the “Controller”.

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Platform, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Platform. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Platform.

All data is processed and stored on infrastructure within the United States of America as of the time of this Privacy Notice.

Retention

We retain personal information for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, billing, or reporting requirements, to establish or defend legal claims, or for fraud prevention purposes.

To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.

Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page with a notice that the privacy policy has been updated on the Platform home page. If we make material changes to how we treat our users' personal information, we will notify you through a notice on the Platform home page. The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Platform and this privacy policy to check for any changes.
